Hello and welcome to our April/May issue, the main focus of this issue is negligence.
Negligence is the failure to take proper care over something. While seemingly straightforward,
the concept of negligence itself can also be broken down into four types of negligence: gross
negligence, comparative negligence, contributory negligence, and vicarious negligence or
vicarious liability.
In this issue we cover the main areas of negligence that involves expert witness including,
‘Understanding Negligence in Healthcare: Insights into the NHS Resolution Early Notification
Scheme’ by Julia Parvia Midwifery expert at Somek & Associates Ltd.
Broker Negligence and Loss of Chance - Norman Hay PLC v Marsh Ltd, The Court of Appeal (CA)
recently handed down its judgment in Norman Hay PLC v Marsh Ltd [2025] EWCA Civ 58 in
which it dismissed the Defendant’s appeal concerning its application to strike out or summarily
dismiss the Claimant’s claim, reaffirming that in cases of brokers’ negligence, the correct approach
is to apply a loss of chance evaluation.
Medical Tattooing in the Medico-Legal World: ‘An Expert Witness Perspective on Negligence’,
medical tattooing is increasingly recognised as a valuable treatment in medico-legal cases,
particularly those involving negligence claims. This article is by specialist Rae Denman.
Medical Malpractice, in 2024, it was expected that the government would introduce fixed
recoverable costs in lower value pre-action clinical negligence an overview by Jonathan
Fuggle claims to drive early resolution and lower costs.
