As part of our preparations for the appeal, we sought
comment from a bene昀椀ts expert to examine the
pursuer’s bene昀椀ts application and universal credit
breakdown.
Conclusions
The outcome clari昀椀es that in situations where
Universal Credit entitlement changes for reasons
unrelated to the accident, it is possible to challenge
the proportion of bene昀椀ts paid as a result of an
accident.
Decision
The Tribunal held that.
ɿ
The pursuer and his partner were not entitled
to Universal Credit prior to the accident due to
their combined earnings.
ɿ
All Universal Credit paid initially was found to
be directly as a result of the pursuer’s accident.
ɿ
However, that a change in circumstances
(the pursuer’s partner stopping work due to
health reasons) resulted in an increase in their
entitlement and that was not due to the pursuer’s
accident.
ɿ
The appeal was allowed in part, and the
recoverable amount was reduced to re昀氀ect
the amount paid as a result of the change in
circumstances.
ɿ
The Tribunal found no binding authority
precluding apportionment of the amounts of
Universal Credit to re昀氀ect di昀昀erent reasons for
payments of those amounts.
Obtaining a detailed breakdown of your client’s
bene昀椀ts, reasons for obtaining bene昀椀ts, whether any
bene昀椀ts application was made on a joint basis and
possibly comment from a bene昀椀ts expert will allow
you to assess the CRU certi昀椀cate and the likelihood
of successfully appealing a proportion of the amount
of recoverable bene昀椀ts.
